A study on the legislation of the concept of genetic discrimination

Abstract

|
As genomic technologies have changed human life, genetic discrimination becomes a prototypical issue that has discussed by genomic researchers, health professionals, patients and society. Whereas the international human right norms have criticized genetic discrimination, this result shows that it is still far to achieve to prohibit genetic discrimination by clearly suggesting the concept of genetic discrimination in the national legislations. The study shows that the approaches of the equal right and the national human rights commission of Korea law have its benefits and limitations though legislation. Genetic discrimination closely links to privacy, consent, understanding the genome information, data provision or sharing, social protection in education, insurance, and employment. The broad and long-term approach to elaborate the concept of genetic discrimination would promote the applicability of the genomic technologies in a sound way. The various follow-up studies on genetic discrimination in the society should be continued.
